Terms of Service

These terms govern your use of golfinthecosmos.com (the “Site”) and any purchase of merch or other goods offered by Cosmos Golf, also known as Golf in the Cosmos (“Cosmos Golf,” “we,” “us”). By using the Site or placing an order, you agree to these terms.

The Site

The Site is an online shop and media site. It includes a podcast, research and betting-preview pages, Labs experiments, and Season One merch. We may change, pause, or remove any page or product without notice.

You must be able to form a contract in your jurisdiction to place an order. If you use the Site for someone else, you are responsible for their compliance.

Accounts and checkout

You may check out as a guest or create an account. You are responsible for the accuracy of the email and shipping address you give us and for activity on your account. The Site is powered by Shopify. Payment is handled by Shopify and its payment providers.

Orders, price, and availability

An order is an offer to buy. We may decline or cancel an order if an item is unavailable, a price or description is wrong, we cannot verify payment, or we cannot ship to the address. If we cancel after a charge, we refund the amount we collected for that order.

Prices are shown in US dollars unless checkout says otherwise. Taxes and shipping are added at checkout when they apply. We do not promise free shipping on these terms.

Product photos and copy are for identification. Colors, embroidery, and blanks can vary. We do not claim customer reviews on this Site, and we do not claim that the whole catalog is Made in the USA.

Shipping and returns

Shipping is described on our Shipping page. Returns and refunds are described on our Returns & Refunds page. The version live on the Site at the time of your order controls.

Intellectual property

Cosmos Golf, Golf in the Cosmos, Moon Man, The Big Bang, Season One, and the related logos, patches, and show materials are identifiers and creative work of Cosmos Golf. You may not copy, sell, or register them, or use them to imply we endorse you, without our written permission.

Podcast audio, research pages, Labs write-ups, and product photography on the Site are ours or used under license. A limited, revocable license lets you view the Site for personal use.

Acceptable use

Do not misuse the Site. That includes breaking the law, probing or overloading the store, planting malware, harvesting other people’s data, posting abuse, or using the Site to resell our merch as if you were Cosmos Golf.

Third-party services

The Site links to Spotify, YouTube, Instagram, X, and other services. Those services have their own terms. Research pages include odds and model output for information. They are not a betting service, not gambling advice, and not a promise of profit.

Disclaimers

THE SITE AND THE PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT LAW ALLOWS, COSMOS GOLF DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Training aids, sim builds, and theory pages (including ProSENDR™, Budget SIM, and the Rule of 12) are informational. You are responsible for how you practice and for any equipment you buy from us or from anyone else.

Limitation of liability

TO THE FULLEST EXTENT LAW ALLOWS, COSMOS GOLF IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING FROM THE SITE OR FROM A PRODUCT, EVEN IF WE WERE TOLD THEY WERE POSSIBLE.

Our total liability for any claim relating to the Site or an order is limited to the amount you paid us for that order, or twenty-five US dollars if you paid us nothing. Some places do not allow these limits. In those places, our liability is limited to the maximum the law allows.

Indemnity

You will defend and indemnify Cosmos Golf and the people who operate the Site against claims, damages, and reasonable legal fees that arise from your use of the Site, your order, or your breach of these terms.

Governing law

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Courts located in California have exclusive jurisdiction, except that we may seek injunctive relief anywhere to protect our marks.
